Terms & Conditions

1. Acceptance of Terms

By purchasing any product or service from Web Scorpions (hereafter referred to as “we”, “us”, or “our”), you (“client”, “you”, or “your”) acknowledge that you have read, understood, and agree to be legally bound by the following terms and conditions. This agreement becomes effective as soon as payment is made, either in full or in part, through any accepted payment method.

2. Services & Payment Terms

  • All services provided by Web Scorpions are prepaid unless a written agreement states otherwise.
  • A detailed invoice outlining the scope of work, deliverables, timelines, and payment terms will be sent prior to project initiation.
  • Once payment is confirmed, your project will be added to our production queue and scheduled for development.
  • Any additional services or revisions requested outside the scope of the original package will be quoted and billed separately.
  • Payments can be made via UPI, bank transfer, Razorpay, Stripe, or other approved payment gateways.

3. Project Timelines & Communication

  • Project start dates are determined by the date of payment and the receipt of all required materials (e.g., logos, content, preferences).
  • Typical delivery timelines range from 48 to 120 business hours for initial drafts, depending on the complexity of the service.
  • Clients must respond to feedback and revision requests within 7 business days to keep the project on schedule.
  • Delays in client communication will result in project delays and may incur reactivation or continuation fees if communication exceeds 14 calendar days.

4. Design Ownership & File Delivery

  • Upon final approval and receipt of full payment, ownership of the completed design or website is transferred to the client.
  • Final deliverables may include static files (JPG, PNG, PDF), layered/editable files (PSD, AI, EPS), or live URLs, depending on the project scope.
  • We are not responsible for lost files after project completion. We recommend clients back up all files promptly.
  • Editable/source files are only delivered if explicitly included in the package purchased. Otherwise, they can be provided for an additional fee.

5. Revision Policy

  • Each project includes a limited number of revisions, as specified in your selected package.
  • Revisions must be requested within 7 business days of draft delivery. Delayed revision requests may be treated as new changes and billed accordingly.
  • Revisions are limited to the original concept scope. Major changes or redesigns (e.g., color schemes, layout shifts, structure overhaul) beyond the included revisions are subject to additional charges.
  • Once final files are delivered, any future changes are considered a new service request.

6. Refund & Cancellation Policy

We strive to deliver outstanding creative services. However, we maintain a strict but fair refund policy to protect both parties’ time and resources.

a. Non-Refundable Circumstances

Refunds will not be provided under the following conditions:

  • If any initial concept, design draft, or mock-up has been delivered.
  • If revisions have been requested or completed.
  • If the client fails to communicate or respond for more than 10 consecutive days.
  • If the client hires or consults a third party to perform the same or similar services during the project.
  • If the client decides to cancel due to internal disagreements, change of mind, or unrelated personal or business reasons.
  • For any service where the work has been partially or fully completed.
b. Eligible Refund Scenarios

Refunds may be considered in the following cases:

  • If the project has not been initiated, and no design drafts or creative work have been delivered, a 50% refund may be granted.
  • Requests for refunds must be submitted in writing via email within 10 days of payment.

⚠️ All refund decisions are subject to internal review and approval by our accounts team.

c. Effect of Refund
  • If a refund is granted, all intellectual property and design rights remain with Web Scorpions.
  • The client agrees not to use, modify, reproduce, or publish any work, concepts, or files provided before the refund.
  • Any unauthorized use of refunded materials will be considered a breach of copyright and subject to legal action.

7. Project Cancellation

  • Cancellations must be requested in writing.
  • If work has begun, a pro-rated cancellation fee will apply based on the amount of work completed.
  • Deposits or partial payments made for booking the project or blocking dates are non-refundable.

8. Marketing & Portfolio Rights

  • Web Scorpions reserves the right to showcase completed work, including but not limited to logos, social media designs, and websites, in its online and offline portfolios, social media, and advertising materials.
  • If you wish to keep your project private or under NDA, please notify us in writing prior to project commencement.

9. Disclaimers

  • Web Scorpions is not liable for:
    • Third-party errors (printers, hosts, domain registrars, etc.).
    • Losses caused by client misuse, poor handling, or unauthorized edits.
    • Missed timelines due to delayed client responses or unclear instructions.
  • Our services are delivered “as-is.” We do not guarantee specific financial results, traffic increases, or business success following the delivery of design or marketing work.
